Can a Master release cargo without original bills of lading against an LOI?
Never without explicit written instructions from the registered shipowner. Releasing cargo without presenting original bills of lading strips the vessel owner of standard P&I club insurance cover for misdelivery claims. The Master must await confirmation from the owner and P&I club legal counsel validating the wording and financial security of the Letter of Indemnity (LOI).
What defines the legal scope of Master's Overriding Authority?
Under SOLAS Regulation V/34-1 and Section 5.2 of the International Safety Management (ISM) Code, the Master possesses overriding authority and personal responsibility to make decisions regarding safety of life at sea, vessel security, and marine pollution prevention. No charterer, owner, or commercial manager may constrain or override the Master's discretionary decisions in these regards.
What is the Master's legal obligation regarding General Average?
Under the York-Antwerp Rules, a General Average act requires an extraordinary, intentional, and reasonable sacrifice or expenditure to preserve common maritime property from real danger. Group A cargoes (such as nickel ore or iron ore fines) can liquefy if their actual moisture content exceeds the Transportable Moisture Limit (TML). The Master must refuse loading if moisture levels exceed the certified TML. Liquefaction creates a free surface slurry that shifts violently under vessel motion, causing sudden loss of intact stability and rapid capsize.
